What is the Marchman Act?

The State of Florida put the Marchman Act in place to assist families who have a loved one who is substance abuse impaired; and because of such impairment, he or she (1) has lost the power of self-control with respect to substance use, and either (2) has inflicted or is likely to inflict physical harm on him or herself or others unless admitted, or (3) his or her judgment is so impaired that he or she is incapable of appreciating his or her need for care and of making a rational decision regarding the need for care, or (4) has refused to submit to voluntary assessment. When your loved one is incapable of helping themselves the Marchman Act gives families of addicts the power to take the addict out of their environment and put them into a hospital for assessment and stabilization, involuntarily and against their will if so needed.
